The Golden Bear, legendary golfer Jack Nicklaus, just won a big defamation lawsuit. Against billionaire banker Howard Milstein and other officials connected to the Nicklaus Companies, he awarded himself $50 million. The ruling is a huge victory for Nicklaus, who has been the subject of damaging allegations that have hurt his reputation and business interests. Milstein and others argued that Nicklaus’ mental incapacity prevented him from controlling his company. They even implied that he may be going senile.
Eugene Stearns, Nicklaus’ attorney, said he was pleased with the resolution, noting that vindication was of paramount importance to his client. “It’s always hard in a defamation case to prove damages to reputation, because in particular for a guy like Jack, it’s always such a good one,” Stearns noted. This judgment underscores the court’s recognition of the harm caused by false statements regarding Nicklaus’ mental and professional capabilities.
The fight originated in 2017 when Jack Nicklaus stepped down from the Nicklaus Companies, starting the countdown for a five-year noncompete agreement. This contract prevented him for that time period from designing golf courses on his own. In late April, New York Civil Division Supreme Court Justice Joel M. Cohen issued a stunning decision. He went on to explain that Nicklaus is free to use his name, image, and likeness as he sees fit. This far-reaching ruling let him take back some degree of control over his brand in the face of previously mentioned constant fighting.
In July 2024, a Florida arbitrator determined that Nicklaus was no longer bound by the noncompete clause, granting him the freedom to design golf courses again. This decision comes after three and a half years of battling. It originates from lobbying by LIV Golf, based on public statements they forced the Nicklaus Companies to make, which accused him of putting a financial agreement with LIV Golf ahead of his obligations to the PGA Tour.
In May 2022, Nicklaus stepped down from the company’s board, further distancing himself from an organization that had become embroiled in controversy. During his initial conversations with Golf Saudi, Nicklaus learned they were looking to make him a chairman of sorts for LIV Golf. “I have little doubt about the outcome, but I don’t intend to make this a public spectacle if it can be avoided,” said Nicklaus in response to the ongoing legal battles and public scrutiny surrounding his decisions and mental acuity.
The conflict escalated further when the Nicklaus Companies allege Nicklaus was attempting to “sell out” to LIV Golf. Nicklaus has categorically rejected this charge. “What they said was, ‘You need to have the keys taken away,’” Stearns remarked, highlighting the gravity of the allegations made against Nicklaus.
